Enterprises must provide protective equipment for workers

In June 2012, Liu was hired as a saw operator at a wood processing factory and signed a five-year labor contract. During his time at the factory, he noticed that experienced workers in his team were provided with protective glasses and gloves. He then requested the factory to supply him with similar safety equipment. However, the factory claimed that since Liu was still in the probationary period and not yet a formal employee, they were not obligated to provide such items. This led Liu to file a complaint with the local labor arbitration department.

The labor arbitration body ruled that labor protection equipment is essential for ensuring the safety and health of workers during their daily tasks. These items help reduce occupational risks and prevent accidents. According to national labor laws, employers are required to provide necessary protective gear that meets state standards. Specifically, Article 54 of the Labor Law states that employers must ensure safe working conditions and supply appropriate protective equipment. Additionally, Articles 74 and 77 of the "Plant Safety and Hygiene Regulations" outline specific requirements, including providing work clothes, caps, masks, gloves, and safety glasses for workers exposed to hazards like noise, bright light, sparks, or sharp debris.

Despite Liu being in the probationary period, the arbitration panel determined that denying him protective equipment violated his basic rights to workplace safety. The decision emphasized that all employees, regardless of their status, are entitled to proper labor protection. The factory was ordered to rectify the issue, and it agreed to comply with the ruling by issuing the necessary safety supplies to Liu.

Liu Ancai, an attorney from the Shenyang Workers’ and Staff Legal Aid Center, explained that every worker, regardless of employment status, has the right to be protected in the workplace. Employers are legally responsible for ensuring the safety of their employees, and failure to provide adequate protective equipment could result in serious legal consequences.
